Terms and Conditions – Beyond Better Biology

Effective Date: May 9, 2025

Welcome to the Beyond Better Biology website. These Terms and Conditions (“Terms”) govern your access to and use of the Beyond Better Biology website and telehealth services. By accessing this website or using our telehealth services, you acknowledge that you have read, understood, and agree to be bound by these Terms. This constitutes an “Acceptance of Terms.”  If you do not agree, you must not use this website or our services. We may update these Terms from time to time by posting revisions here, and your continued use of the site or services constitutes acceptance of the updated Terms.

1. Scope of Service

Beyond Better Biology (“we” or “us”) is a Pennsylvania-based telehealth clinic offering elective wellness services, including Testosterone Optimization Therapy (“TOT”), Hormone Replacement Therapy (“HRT”), peptide therapy, and bloodwork consulting. Our services are provided by licensed healthcare providers via telemedicine (remote consultations). Our services are supplemental to your regular medical care and are not intended to replace the care of a primary care physician or appropriate medical specialist. We strongly encourage you to maintain an ongoing relationship with a primary care provider for routine health needs, preventive care, and the management of any chronic or serious medical conditions. Any specialized issues outside the scope of our elective wellness therapies should be addressed by an appropriate specialist; our evaluations focus only on the specific optimization and wellness services we offer.

Our providers will review your health history and goals and may order laboratory tests or prescribe therapies related to TOT, HRT, or peptides as appropriate. However, we do not provide comprehensive primary care or specialty disease management – for example, we do not manage emergencies, complex chronic diseases, or conditions outside our elective therapy scope. Use of our telehealth services does not create an ongoing exclusive physician–patient relationship for all your medical needs; it is limited to the specific services we provide. You agree that any information or guidance provided by Beyond Better Biology is specific to your wellness therapy plan and not general medical advice for undiagnosed symptoms or unrelated conditions.

2. Medical Disclaimer (No Medical Advice on Website)

The content on this website (including articles, FAQs, and informational materials) is provided for general educational and informational purposes only. This website content is not intended as medical advice and is not a substitute for professional medical diagnosis, treatment, or advice from your physician. While our site may discuss health topics, individuals should not use this information to self-diagnose or treat any health condition.Always seek the advice of a qualified healthcare provider (such as your personal physician) with any questions about a medical condition or before starting any new treatment. Never disregard professional medical advice or delay seeking it because of something you read on this website.

Nothing on this site creates a doctor-patient relationship between you and Beyond Better Biology or any of its providers. Only when you formally enroll as a patient, complete required consents, and a Beyond Better Biology provider accepts you for treatment does a provider-patient relationship arise. If you are not an established patient and you have or suspect you have a medical problem, please consult your own physician. Use of this website or sending us inquiries does not guarantee that we can accept you as a patient or provide treatment. We reserve the right to refer you to in-person care or decline to provide services if we determine your needs fall outside our scope or if telehealth is not appropriate for your situation.

3. No Emergency Services

Beyond Better Biology’s telehealth services are notintended for medical emergencies or urgent situations. Our providers do not address medical emergencies via telehealth. If you are experiencing a potentially life-threatening or urgent medical emergency – for example, symptoms of a heart attack or stroke, severe shortness of breath, chest pain, acute severe pain, suicidal ideation, or any condition you believe is life-threatening – call 9-1-1 immediately and/or go to the nearest emergency room. Do not attempt to use this website or our telehealth platform to seek emergency care, as we are not equipped to provide emergency intervention.

After any emergency care, you should follow up with your primary care provider or appropriate specialist for ongoing management. You acknowledge that electronic communications (such as messaging or telehealth visits) are not suitable for urgent or emergency medical needs. Beyond Better Biology is not liable for any delay or failure to obtain emergency treatment. If you have an urgent medical concern that is not life-threatening but cannot wait for a telehealth appointment, you should seek care at an urgent care or other appropriate facility rather than using our services.

4. Eligibility (U.S. Residents, Adults Only)

Our services are intended only for individuals who are U.S. residents aged 21 or older. By using our site or telehealth services, you represent and warrant that you are at least 21 years of age and legally competent to enter into this agreement. Persons under 21 (or under the age of majority in your state) are not eligible to use Beyond Better Biology’s services, and we do not knowingly collect information from minors. If you are under 21, do not attempt to register or send us any personal information.

You also represent that you reside in the United States and are located in the U.S. at the time of receiving our services. We do not offer services to individuals outside the United States, and information on our site is not intended for users in any jurisdiction where offering such telehealth services would be unlawful. You are not allowed to use this website or receive telehealth services if prohibited by any applicable law or regulation in your location. We may require verification of your age and residency (such as a government ID) before providing services. If we discover that you do not meet these eligibility requirements, we will terminate services and any accounts you have established.

5. Telehealth Informed Consent and Service Limitations

By using our telehealth services, you consent to receive healthcare via telemedicine. This means our communication will occur through secure electronic means (such as video calls, phone calls, and/or secure messaging). You acknowledge and understand the following regarding telehealth:

  • No      In-Person Physical Examination: Telehealth involves remote evaluation      and does not allow for a hands-on physical examination by the      provider. The provider relies on information you provide, video      observation, and third-party diagnostic data (like lab results). Some      conditions or complaints may not be appropriate for telehealth evaluation     due to the inability to examine you in person. Our providers will      determine if your particular issue can be adequately addressed via      telehealth. If not, we will direct you to seek in-person care. 
  • Technological      Limitations: Telehealth services depend on technology (internet,      video, software) that may malfunction or fail. You understand there is      a risk of technical difficulties or equipment failures (e.g., poor      connectivity, software crashes) that could cause delays, interruptions, or      loss of information during your consultation Beyond Better Biology. In the event of a technology      or connection failure, the session may need to be rescheduled or      supplemented by other means. Beyond Better Biology is not responsible      for technical problems beyond our control. You agree to hold us      harmless for any delays in evaluation or lost information due to such      technical issues. 
  • Privacy      and Security Risks: We use secure, encrypted platforms to conduct      telehealth visits and to communicate with you. However, in rare cases,      security protocols could fail, potentially causing a breach of privacy of      your personal medical information. You agree to take precautions on      your end as well (e.g., using a private internet connection and conducting      sessions in a private location). Beyond Better Biology employs safeguards      to protect your data, but we cannot guarantee 100% security of      electronic communications. By using our telehealth services, you      accept the small risk that a technical failure or security incident could      occur. 
  • Incomplete      Information: Telehealth providers may not have access to all of your      medical records or information that an in-person exam might reveal. There      is a risk that lack of complete information (such as unavailable medical      history or records) could result in adverse drug interactions, allergic      reactions, or other judgment errors. You agree to fully disclose      your medical history, conditions, medications, and any relevant      information to the best of your ability to mitigate this risk. It is      your responsibility to inform our providers of any changes or new      information in your health status. 

By proceeding with a telehealth consultation, you acknowledge these potential limitations and risks of telehealth and consent to receive care under these conditions. You have the right to withhold or withdraw consent to telehealth at any time. If you withdraw consent, understand that we may not be able to continue providing services to you (except if you choose to seek in-person services if available). If telehealth is not effective for your particular concern, we may refer you for an in-person evaluation with a local healthcare provider. You agree to seek in-person medical care if recommended by our providers or if your condition necessitates it (for example, if your symptoms persist or worsen despite telehealth treatment).

6. Not a Substitute for Primary Care or Specialist Care

Beyond Better Biology’s services are focused on elective hormone optimization and wellness therapy. Our telehealth care is an addition to – and not a replacement for – your relationship with a primary care provider. We do not provide comprehensive primary care, routine screenings (outside of our specific protocols), or specialty consultations for complex conditions. You must continue to rely on your primary care physician for general healthcare, routine check-ups, immunizations, and any new or ongoing medical issues not related to the services we offer. If you have a condition or develop symptoms that fall outside our scope (for instance, a new unrelated illness or a complication requiring a specialist), you agree to promptly seek care from your primary care provider or an appropriate specialist.

Any recommendations or medications provided by Beyond Better Biology are intended to address the specific hormone or wellness issues for which you engaged our services. If you experience any side effects, adverse reactions, or new symptoms during or after treatment with us, you agree to immediately notify our providers and also consult your primary care provider or appropriate specialist as needed. For example, if we are managing your testosterone optimization and you develop an unrelated health issue (like high fever, injury, or signs of a heart problem), you must contact your regular doctor or specialist – our platform is not intended to manage such issues. Likewise, if our evaluation or your lab results reveal any abnormalities outside our area (e.g., a critical lab value or a suspected serious condition), we will direct you to seek evaluation by your primary care physician or a relevant specialist, and you agree to do so.

You understand and agree that any guidance given by Beyond Better Biology does not override or replace the medical judgment of your other healthcare providers. You should continue regular check-ups with your personal doctors. If any provider (ours or your PCP) advises you to get certain follow-up or additional care, it is your responsibility to follow that advice. Beyond Better Biology is not responsible if you choose to ignore or delay following up with your primary care or specialist after we have recommended you do so.

7. Patient Responsibilities

To ensure safe and effective care, you have important responsibilities as a patient using our elective telehealth services:

  • Provide      Accurate Information: You agree to provide truthful, accurate, and      complete information about your health, medical history, symptoms,      medications (including supplements or recreational substances), and any      relevant lifestyle factors. This includes answering all intake questions      fully and honestly, and updating us on any changes in your health status.      We rely on the information you provide to make clinical decisions; we      are not liable for issues arising from information withheld or      inaccuracies in your disclosures. 
  • Follow      Treatment Plans: If you and our provider agree on a treatment or      monitoring plan (such as taking medications, administering therapies,      obtaining lab tests, or lifestyle modifications), you commit to following      those instructions. If you choose not to follow the recommended plan,      or fail to take medications or tests as prescribed, you assume      responsibility for any resulting consequences. Always use medications      as directed and report any problems or side effects promptly. 
  • Use      Medications Safely: Some therapies, like testosterone or other      hormones, may be controlled substances or potent medications. You agree to      use any prescribed medications only as directed for your personal use.      Do not share or divert medications. Store them safely out of reach of      others. You understand that misuse of prescribed hormones or peptides can      be dangerous and is your responsibility. We reserve the right to      discontinue care if we suspect misuse or non-compliance. 
  • Communication:     You are responsible for having the necessary technology for telehealth      (e.g., a functioning camera, microphone, and internet connection). Please      ensure you are available at scheduled appointment times in a private,      quiet environment. If you have questions or experience side effects or      issues, you should communicate with us through the provided secure      channels. We strive to respond within a reasonable time, but our      telehealth platform is not monitored 24/7. Do not use it to communicate      emergency issues (as noted above). For non-urgent inquiries, we may      provide secure messaging or email—however, clinical questions should be      reserved for scheduled consultations when possible for a thorough      discussion. 
  • Follow-Up      and Primary Care: As emphasized, you agree to contact your primary      care physician for any concerns or abnormalities that fall outside or      arise outside of our treatment plan. If our provider advises a certain      follow-up (for example, seeing a specialist, repeating a lab test, or      getting imaging), you are responsible for arranging that follow-up. We may      assist with referrals when possible, but ultimately you must take action to      obtain the recommended additional care. If your condition does not      improve or if it worsens, you will seek in-person medical evaluation as      needed without delay. 

By using our services, you confirm that you understand these responsibilities and agree to them. Failure to uphold these patient responsibilities could result in suboptimal outcomes or risks to your health, and Beyond Better Biology will not be liable for any harm resulting from such failure on your part.

8. Assumption of Risk

All treatments and services offered by Beyond Better Biology are elective, and you acknowledge that you are choosing to proceed with them voluntarily and assume all risk inherent to these treatments. While our providers will explain the potential benefits and risks of any recommended therapy (and you will have the opportunity to ask questions before consenting to treatment), there are always risks and uncertainties with medical treatment. For example, hormone therapies and peptide treatments can have side effects (such as changes in blood counts, mood changes, cardiovascular effects, liver function changes, etc.), and individual responses vary. No outcome can be guaranteed or assured, and you understand that results may differ from person to person. You may achieve some or all of the intended benefits, or you may experience no improvement, and there is a possibility of adverse effects.

By undergoing elective TOT, HRT, peptide therapy, or any wellness program through our clinic, you agree that you are assuming 100% of the risk associated with these treatments. This includes both known risks (disclosed to you in advance) and any unforeseen or rare complications that may occur. You acknowledge that medicine is not an exact science and outcomes cannot be guaranteed. You accept responsibility for any outcomes – beneficial or harmful – that may result from the elective treatment you receive.

Furthermore, you agree that Beyond Better Biology and its providers have made no guarantees to you regarding cure or specific results.Any examples of success or testimonials on our site are illustrative and do not promise that you will achieve the same outcomes. You have had the opportunity to consider alternatives, including doing nothing, and still elect to proceed with our services with an understanding of the risks. If you do not fully accept the risks of a proposed treatment, you should not proceed with it.It is your right to decline or defer any recommended treatment if you are uncomfortable with the risk profile.

9. Limitation of Liability

To the fullest extent permitted by law, Beyond Better Biology, its owners, clinicians, staff, affiliates, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from your use of this website or our telehealth services. This limitation of liability includes, but is not limited to, any loss, damage, injury, or claim arising from: (a) your reliance on any information provided on this website or during telehealth consultations; (b) any misdiagnosis or failure to diagnose a condition due to limits inherent in telehealth (such as lack of physical examination or incomplete information) when we have exercised the level of care reasonably expected of telehealth providers; (c) any decisions you make regarding your health or medical care outside of our advice; (d) technical failures or unavailability of our platform; or (e) unauthorized access or misuse of our website, except where such loss is caused by our gross negligence or willful misconduct.

Beyond Better Biology provides all services and information “as is” and makes no warranties or representations, express or implied, about the accuracy, reliability, completeness, or suitability of the information or services for any purpose. We disclaim any implied warranties of merchantability or fitness for a particular purpose, and any warranty that the service will be uninterrupted or error-free. We do not guarantee that communications through our site will be secure or not lost, though we take precautions to protect your data.

In jurisdictions that do not allow certain liability exclusions or limitations, our liability will be limited to the minimum extent permitted by applicable law. In no event will our cumulative liability to you, for all claims relating to your use of the site and services, exceed the total fees you have paid to Beyond Better Biology for services in the past 12 months (if any), or $100, whichever is greater. This limitation reflects the allocation of risk between you and us as part of this agreement. You acknowledge that were it not for these limitations, the fees charged for our services (if any) would be higher.

10. Release and Hold Harmless

By using our services, you hereby release, waive, and agree to hold harmless Beyond Better Biology, its physicians and medical providers, physician assistants and nurse practitioners, nurses, health coaches, administrators, owners, directors, officers, employees, contractors, agents, affiliates, successors, and assigns (“Released Parties”) from any and all liability, claims, demands, or causes of action arising out of or related to your use of this website or receipt of our telehealth services, to the maximum extent permitted by law. This release of liability and hold harmless agreement includes, but is not limited to, any injury, loss, or damage – whether known or unknown, foreseen or unforeseen – that you may sustain as a result of: (a) participating in our wellness programs; (b) any advice or treatment provided by the Released Parties; or (c) any complication or side effect of a treatment, including those that may arise from the ordinary negligence (but not gross negligence or willful misconduct) of the Released Parties.

You expressly acknowledge that elective medical treatments carry risks and by engaging our services you assume those risks (as described in Section 8 above). Therefore, you agree that you will not hold the Released Parties liable for any outcome you experience. For example, if you experience an adverse effect from a hormone therapy, you will not pursue a claim against our clinic or staff for that outcome, as you have agreed to assume the risk. Similarly, if a telehealth limitation results in a missed diagnosis of an unrelated condition, you agree that we are held harmless for that consequence, as you understand and accepted the limitation and the need to follow up with in-person care as appropriate.

This hold-harmless clause is a material part of this agreement. If you do not agree to release us from liability for elective treatment outcomes, please do not use our services. Your acceptance of these Terms indicates a clear agreement that you bear all risks and will not seek to hold Beyond Better Biology or its associates responsible for any harm or perceived harm arising from your voluntary participation.

Note: This release does not waive any rights you may have that cannot be lawfully waived, such as the right to file a professional malpractice claim for gross negligence under applicable state law. It also does not release any claims that you may have against product manufacturers (for example, if a medication were contaminated). It is specifically intended to release claims against Beyond Better Biology and related persons for the inherent risks of elective treatments and the ordinary risks of telehealth, as well as any ordinary negligence in providing services. In any case, our liability is limited as stated in Section 9.

11. Indemnification

In addition to the above release, you agree to indemnify, defend, and hold harmless Beyond Better Biology and its owners, officers, employees, contractors, and agents from and against any and all third-party claims, losses, liabilities, damages, taxes, expenses, or costs (including reasonable attorneys’ fees and court costs) arising out of or relating to: (a) your violation of these Terms; (b) your violation of any law or regulation through your use of our site or services; or (c) any content you post or actions you take that infringe or violate the rights of any other person. This means that if a third party (for example, another healthcare provider or an insurance company) were to sue us because of something you did (for instance, misuse of medication obtained through our service, or unauthorized use of someone else’s information), you would be responsible for any costs or damages incurred by us due to your conduct.

12. Privacy and Data Security

Your privacy is very important to us. We maintain a separate Privacy Policy (see the link in our website footer) that describes how we collect, use, and protect your personal information. By using our site and services, you consent to the practices described in our Privacy Policy. In the context of these Terms, we emphasize the following:

  • No      Personal Health Data Stored on Website: We do not store any      personal health information (PHI) on the public-facing website servers.      The website itself is primarily informational. When you provide health      information through our platform (for example, by filling out intake forms      or during telehealth visits), that data is transmitted through secure,      encrypted channels to our electronic health records system or secure      third-party service, not on this website’s general server. This is      a deliberate measure to protect your sensitive information. Thus, if our      public website were ever compromised, it would not contain your      confidential medical data. We implement administrative, technical, and      physical safeguards to protect all health information you share with us,      in compliance with applicable privacy laws. 
  • HIPAA      Compliance: As a healthcare provider, Beyond Better Biology follows      the requirements of the Health Insurance Portability and Accountability      Act (HIPAA) and other applicable state and federal privacy laws. We will      only use or disclose your protected health information as permitted by law      and as described in our Privacy Policy and any Notices of Privacy      Practices we provide. Although no system is 100% secure, we use      industry-standard security measures to protect your data. However, you      also play a role in security: please ensure that any device you use      for telehealth is secure and that you keep your login credentials      confidential. We are not responsible for breaches of privacy arising from      your own device security failures or sharing of account access. 
  • Limits      of Confidentiality in Telehealth: Our telehealth sessions are      conducted privately, and we will not record video or audio of sessions      without your consent (and we typically do not record sessions at all). You      are also not permitted to record sessions without informing us. Bear in      mind that if you are in a location where someone could overhear you, we      cannot guarantee confidentiality on your end – choose a private setting.      Additionally, by law, if you disclose certain information (like intent to      harm yourself or others, or abuse of a minor or elder), we may be required      to break confidentiality to ensure safety or report to authorities. 
  • No  Sale of Data: We do not sell your personal data. Any analytics or      cookies on our website are used in accordance with our Privacy Policy and      do not include personal health details. If you create an online account      with us, you are responsible for maintaining the confidentiality of your      username and password and for all activities under your account. 

For more detailed information on how we handle data, please review our Privacy Policy. By agreeing to these Terms, you also agree to our Privacy Policy. If you have questions about how we protect your information, you may contact us using the information in the “Contact Us” section below.

13. Payment and Refund Policy

Beyond Better Biology strives to be transparent in all financial matters. By receiving services or making purchases through our clinic, you agree to the following payment and refund terms:

  1. No      Refunds on Medications, Supplements, or Bloodwork
    • There       is no returns of any kind on any item provided, sold, or prescribed by       Beyond Better Biology or its affiliates. 
    • All       purchases of medications, supplements, peptides, injectables, or any       related products are final and non-refundable once they have been ordered,       shipped, or received, regardless of usage status.
    • Bloodwork       scripts (labs) are also non-refundable once they have been ordered,       whether or not the testing has been fulfilled or completed.

  1. Missed      or Late Appointments
    • Missed       appointments or cancellations with less than 24 hours' notice are subject       to a fee ranging from $50 to $125 per occurrence, depending on service       type.
    • This       includes, but is not limited to: mobile phlebotomy visits, telehealth       consultations, in-office appointments (when applicable), and phone       consultations.
    • A       15-minute grace period will be honored. After this time, the appointment       may be considered missed and subject to the fee.

  1. Responsibility      for Delivered Medications
    • Once       a medication, supplement, or treatment is marked "delivered" by       the carrier (e.g., USPS, UPS, FedEx), Beyond Better Biology and its       affiliates, including pharmacy partners, are not responsible for the       security or handling of the package.
    • Patients       assume full responsibility for medications or items delivered to their       address. Lost or stolen packages are not eligible for replacement or       refund.
    • If       you believe your package has been lost or stolen, please contact us to       discuss alternative options.

  1. Insurance      and Financial Responsibility
    • Beyond       Better Biology does not accept insurance or participate in Medicare,       Medicaid, or other third-party payors.
    • The       patient agrees to be fully and solely responsible for any and all medical       bills incurred at any time, regardless of whether the procedure was       performed through Beyond Better Biology or in connection with services       provided.
    • Patients       understand that many of our treatments may be elective in nature, and as       such, may carry mild to severe risks. By proceeding with care, the       patient affirms that they understand the potential risks and still wish       to undergo treatment.
    • By       agreeing to receive services, the patient and their families agree to       hold harmless In Good Health Managements LLC (dba Beyond Better Biology),       its affiliates, members, providers, and staff from any and all liability,       damages, or adverse events arising from or related to services rendered.

14. Intellectual Property

All content and materials on the Beyond Better Biology website – including text, graphics, logos, images, designs, videos, software, and other content – are the property of Beyond Better Biology or its content suppliers and are protected by copyright, trademark, and other intellectual property laws. The compilation of all content on this site is the exclusive property of Beyond Better Biology. You are granted a limited, revocable license to access and use the website for personal, informational, and non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our site content without express written permission from us.

All trademarks, service marks, and logos displayed on the site (including the Beyond Better Biology name and logo) are registered and unregistered marks of Beyond Better Biology or third parties who have authorized their use (such as partners). You are not granted any right or license to use any trademarks without the owner’s prior written consent.

If you submit any feedback, suggestions, or other communications to us regarding our services or site, you acknowledge that such submissions are non-confidential and that we are free to use or disseminate them without compensation to you, for any purpose.

15. Termination of Use

We reserve the right to refuse service, terminate accounts, or restrict access to the site or services at our sole discretion, particularly if a user violates these Terms or engages in behavior that is abusive, fraudulent, or prejudicial to our interests or the health of the user or others. We may also terminate your use if we determine we cannot safely or appropriately provide services to you (for example, if you move outside our service area, or if you continually fail to follow medical advice in a way that poses risk). In the event of termination, we will provide notice and may offer to transfer your care or records to a provider of your choice. Sections of these Terms that by their nature should survive termination (such as payment obligations, assumption of risk, releases, and indemnifications) will remain in effect after termination.

16. Governing Law and Dispute Resolution

These Terms and your use of the website and services are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of laws principles. By using the site or services, you agree that any dispute arising out of or relating to these Terms or our services that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the state or federal courts located in Pennsylvania. You consent to personal jurisdiction and venue in Pennsylvania for such disputes. We operate from Pennsylvania and do not seek to subject ourselves to the laws or jurisdiction of any state, country, or territory other than Pennsylvania, except to the extent we must comply with health regulations in states where we provide telehealth services.

By agreeing to these Terms and Conditions, you agree that any dispute, claim, or controversy arising out of or relating to your use of this website, our services, or any treatment provided by Beyond Better Biology—including disputes arising from or concerning interpretation, violation, invalidity, non-performance, or termination of this agreement—shall be resolved exclusively through binding arbitration in Chester County, Pennsylvania, and not in a court of law.

This arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA), using a single arbitrator. The arbitrator shall be selected by mutual agreement of the parties or, if the parties cannot agree, in accordance with the AAA rules. The arbitrator’s decision shall be final and binding, and judgment may be entered on it in any court of competent jurisdiction.

Each party will be responsible for its own legal fees and costs unless otherwise determined by the arbitrator. This clause shall not preclude parties from seeking injunctive relief in a court of competent jurisdiction in Chester County, Pennsylvania, for matters involving intellectual property or misuse of confidential information.

By agreeing to these Terms, you waive your right to a jury trial and to participate in class action lawsuits or class-wide arbitration.

This shall apply to Small Claims or Injunctive Relief

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect. Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce it in the future.

18. Entire Agreement

These Terms, together with our Privacy Policy and any informed consent or other agreements you sign in the course of receiving services, constitute the entire agreement between you and Beyond Better Biology regarding the use of our website and services. They supersede all prior understandings or agreements (whether oral or written) regarding the same subject matter. In case of a conflict between these Terms and any specific service agreement or informed consent you sign, the specific terms of the latter will prevail for that conflict. No oral modifications or additions to these Terms are permitted; any changes must be in writing (including updates posted on our website by Beyond Better Biology as described above).

19. No Waiver

No waiver by Beyond Better Biology of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term, and any failure of Beyond Better Biology to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

Return and Refund Policy

Payment and Refund Policy

Beyond Better Biology strives to be transparent in all financial matters. By receiving services or making purchases through our clinic, you agree to the following payment and refund terms:

  1. No Refunds on Medications, Supplements, or Bloodwork
    • There are no returns of any kind on any item provided, sold, or prescribed by  Beyond Better Biology or its affiliates. 
    • All purchases of medications, supplements, peptides, injectables, or any related products are final and non-refundable once they have been ordered, shipped, or received, regardless of usage status.
    • Bloodwork scripts (labs) are also non-refundable once they have been ordered, whether or not the testing has been fulfilled or completed.

  1. Missed or Late Appointments
    • Missed appointments or cancellations with less than 24 hours' notice are subject to a fee ranging from $50 to $125 per occurrence, depending on service  type.
    • This  includes, but is not limited to: mobile phlebotomy visits, telehealth consultations, in-office appointments (when applicable), and phone consultations.
    • A 15-minute grace period will be honored. After this time, the appointment  may be considered missed and subject to the fee.

  1. Responsibility  for Delivered Medications
    • Once   a medication, supplement, or treatment is marked "delivered" by the carrier (e.g., USPS, UPS, FedEx), Beyond Better Biology and its       affiliates, including pharmacy partners, are not responsible for the  security or handling of the package.
    • Patients  assume full responsibility for medications or items delivered to their  address. Lost or stolen packages are not eligible for replacement or  refund.
    • If  you believe your package has been lost or stolen, please contact us to  discuss alternative options.

  1. Insurance and Financial Responsibility
    • Beyond Better Biology does not accept insurance or participate in Medicare,  Medicaid, or other third-party payors.
    • The  patient agrees to be fully and solely responsible for any and all medical  bills incurred at any time, regardless of whether the procedure was  performed through Beyond Better Biology or in connection with services provided.
    • Patients  understand that many of our treatments may be elective in nature, and as such, may carry mild to severe risks. By proceeding with care, the  patient affirms that they understand the potential risks and still wish  to undergo treatment.
    • By  agreeing to receive services, the patient and their families agree to hold harmless In Good Health Managements LLC (dba Beyond Better Biology),  its affiliates, members, providers, and staff from any and all liability,  damages, or adverse events arising from or related to services rendered.
